Under the Collaborative Divorce principles and guidelines, each party retains their own Collaborative Divorce Attorney. The lawyers and parties enter into a Stipulation agreeing that they are choosing not to litigate their case and the couple promises to cooperate with each other in good faith, including full disclosure of all community and separate property assets and debts. The goal is to engage in a joint effort to resolve all divorce related issues in a peaceful manner and preserve relationships, especially when there are children involved. Should either party fail to act in good faith or decide that the collaborative process is not producing results, each party retains the right to choose to litigate their case, but both lawyers are required to immediately withdraw their representation.
